RELEASE/WAIVER OF LIABILITY/INDEMNITY AGREEMENT
In consideration of my participation in boxing activities at OUT WEST BOXING LLC, I acknowledge that such activities, which involve public gatherings, entail various risks, both known and unknown. I hereby accept and assume all risks associated with my involvement in these activities.
Furthermore, I agree to indemnify and hold harmless OUT WEST BOXING LLC, along with its members, affiliates, agents, directors, employees, volunteers, and any other individuals affiliated with OUT WEST BOXING LLC, from any liability relating to claims, demands, damages, and causes of action of any nature that may arise from my participation in these activities or the use of any equipment within the boxing facility during my experience.
I hereby acknowledge and accept that participation in boxing and fitness training entails inherent risks. I am fully aware of the potential for injury or even death associated with these activities, and I voluntarily engage in such activities, utilizing the equipment and facilities, with a thorough understanding of the associated dangers.
I have been encouraged to ensure that my insurance policy appropriately covers these activities.
I affirm that I have taken the necessary steps to obtain any required medical clearances prior to undergoing any physical examination necessary for participation in exercise activities.
I declare that:
I am physically fit and mentally competent to engage in the physical activities I have chosen.
I am in good health and not under the influence of any substances.
I am fully prepared to undertake boxing and any fitness activities offered by OUT WEST BOXING LLC.
CONSENT FOR IMAGE USE
I hereby grant OUT WEST BOXING LLC and its authorized representatives the irrevocable right to utilize my photographs and/or video recordings in their printed materials, social media platforms, websites, and any promotional marketing advertisements without requiring my approval of the finished product.
I release OUT WEST BOXING LLC from any claims for compensation associated with any types of damages, whether anticipated or unanticipated, related to the utilization of these images or videos.
ACKNOWLEDGMENT OF AGREEMENT
By consenting to the terms at the time of payment, through the act of checking a box or via another similar method of acknowledgment, I affirm my understanding and acceptance of this Release/Waiver of Liability/Indemnity Agreement, Consent for Image Use, and all other conditions contained herein.
This agreement is applicable to myself and, where pertinent, to any minor children referenced on the membership application for whom I serve as a parent or legal guardian.
MINOR PARTICIPANTS
If the participant is under the age of 18, it is required that a parent or legal guardian formally acknowledge and accept the terms of this agreement on behalf of the minor through the same acknowledgment method at the time of payment.
